Spousal sponsorship applications are processed with the utmost attention at Canadian Visa Offices as spousal sponsorship is strongly supported by Immigration, Refugees and Citizenship Canada (IRCC). Reunifying families within Canada is one of the goals of the Canadian government. The most sought-after immigration track under the family class is the spouse sponsorship program. For both in-country and out-of-country situations, the processing period for 80% of applications was recently shortened from 26 to 12 months.
A Canadian citizen or permanent resident must sponsor the spouse, common-law partner, or conjugal partner who wants to immigrate to Canada under the spousal sponsorship category. If you sought to sponsor your spouse from outside of Canada, the Canadian immigration authorities will give the applicant a Canada Spouse Visa (a confirmation of permanent residence) after the sponsorship application is authorized and a decision is made.

REQUIREMENTS OF SPOUSAL SPONSORSHIP

If you’re a Canadian citizen living outside Canada, you must show that you plan to live in Canada when your sponsored relative becomes a permanent resident.

    MINIMUM INCOME REQUIREMENTS

    Low-income-cut-offs (LICOs) for spouse, partner, or dependent child sponsorships are typically absent. However, you must reach a minimum LICO score, which is set by the Canadian government annually, if either a dependent kid you are sponsoring has a dependent child of their own, or a spouse or partner you are sponsoring has a dependent child who has dependent children of their own. A Financial Evaluation (IMM 1283) form must be included with your application if you are required to meet LICO standards

    PROCESSING TIME FOR SPOUSAL SPONSORSHIP

    It depends on several factors, such as the type of application, the country of origin, the completeness and accuracy of the application, and the volume of applications received by Immigration, Refugees and Citizenship Canada (IRCC). According to the IRCC website, as of September 2021, the average spousal sponsorship Canada processing time for applications submitted from outside Canada is 12 months, while the average processing time for applications submitted from inside Canada is 17 months. However, these are only estimates and the actual processing time may vary depending on the individual circumstances of each case.

    DOCUMENT CHECKLIST FOR SPOUSE SPONSORSHIP

    To apply for spouse sponsorship, the sponsor and the applicant must submit a complete and accurate application package that includes the following documents:
    • Application forms for the sponsor and the applicant
    • Proof of the sponsor’s status in Canada, such as a citizenship certificate or a permanent resident card
    • Proof of the applicant’s identity, such as a passport or a birth certificate
    • Proof of the relationship between the sponsor and the applicant, such as a marriage certificate, a common-law declaration, or photos
    • Proof of income or savings of the sponsor, such as a notice of assessment, a bank statement, or an employment letter
    • Police certificates and medical exams for the applicant and their dependents
    • Any other documents required by the IRCC or the visa office

    The fees for spousal sponsorship depend on the type and number of applicants. The basic fees are:
    • Sponsorship fee: $75
    • Principal applicant processing fee: $475
    • Right of permanent residence fee: $500
    • Biometrics fee: $85
     
     
    The total fees for one applicant are $1,135. If the applicant has dependent children, there are additional
    fees of $150 per child for the processing fee and $85 per child for the biometrics fee

    To prove that your relationship with your spouse or partner is genuine, you need to provide evidence
    that shows that you have a strong and lasting bond, that you share responsibilities and activities, and
    that you are recognized as a couple by others. Some examples of evidence are:
    • Marriage certificate or common–law declaration
    • Joint bank accounts or credit cards
    • Joint ownership or rental of property
    • Joint utility bills or insurance policies
    • Photos of you together or with family and friends
    • Letters, emails, or messages that show your communication and affection
    • Travel documents or tickets that show your trips together
    • Statements from relatives, friends, or acquaintances who know your relationship

    The language and education requirements for spousal sponsorship are only applicable for dependent children who are 18 years or older. They must:
    • Have a minimum level of Canadian Language Benchmark (CLB) 4 in English or French in all four
    skills (listening, speaking, reading, and writing)
    • Have a Canadian high school diploma or an equivalent foreign credential
    To prove their language and education level, they must provide:
    • A language test result from a designated testing organization, such as IELTS, CELPIP, or TEF
    • A copy of their high school diploma or a credential assessment report from a designated
    organization, such as WES, ICAS, or IQAS
